Supreme Court Issues Notice to Supertech to Refund to Home Buyers

On Wednesday, the NCDRC or National Consumer Disputes Redressal Commission issued notice to the top officials of Supertech Limited, a real estate company, for their response on why they are not going to refund the hard-earned money of home buyers invested on its luxurious ORB residential complex located in Noida because of excessive delay on offering possession. For promoting this project, interior designer and Bollywood actress Twinkle Khanna also received notice by Justice V.K. Jain. Seven flat buyers filed a petition to the Supreme Court for the direction to the developer and to refund their money for failure to justify their promise to deliver possession by 2015. The officials of the company didn’t say anything about the NCDRC’s order when they contacted them.

When talking about the petitioners, Advocate Amit Kumar added that they had deposited whopping Rs. 2 Cr in 2012. But only 12 floors finished construction over the past four years in this project which had 50 floors planned by the company. It seems to take more years by the company to finish the project. According to him, buyers approached the court when the developer failed to refund their money.

In 2012, the project was launched and the developer committed to finish the construction and deliver it by April 2015. But they caused physical and mental harassment and complainants also suffered financial loss due to failure in delivery off lats. On the face of it, it is clear that builder cannot deliver the project in future. It is because they have already exceeded the deadline for project delivery and status also makes things deplorable on the construction of site, according to the petition. For the past two years, there had been hardly any progress seen in construction over the past two years and construction cannot finish over the next 20 years, according to Kumar.

Twinkle Khanna was alleged to promote the project and attracted home buyers to invest in this project. Along with using her name to the project, she also announced that she has designed the flats and project as an interior designer and architect. Supertech’s ORB housing project was introduced in 2012 at Sector 74, Noida and the project has 50 floors in three towers.
