Guwahati: As many as 317 bighas owned by wakf in Assam were illegally occupied. The Assam Wakov Committee had washed their hands only by giving notice to 638 squatters. The Wakov Regional Court is no less than a white elephant. Wakf's property management in prime areas of Assam (including Guwahati) has serious problems. The squatters of the wakf in Assam paid rent that was about 40/50 years ago.
The Indian government revised the Wakf Act in 2013. The 2013 Wakf (Revised) Act authorizes state Wakf commissions and courts to take action against occupiers. The board of directors can mobilize deputy commissioners who seek to evict squatters. The developing countries can expel them. The revised bill also authorizes the Wakf Court to resolve the case within six months. The civil courts have no role in resolving wakf property disputes, but the government of Assam has not yet implemented the revised Wakf Act.
In order to implement the revised law, the state government must have strongly proven suggestions, action proofed backups to establish the necessary rules to implement the law. According to official sources, a pressure group has been working overtime to block the state’s revised Wakoff law. The lobby is mainly composed of wakf squatters. Some of them later appealed to the civil court against the notice issued by the Wakf Commission.
The issue of permanent trials is also an obstacle to the expulsion of squatters. If the Waqf regional courts have been active, the civil courts will have no effect here. According to official sources, since 2017, the government has managed the Wakov Regional Council. The government has not appointed any community representatives to lead the board of directors. Although the Wakf Commission has notified 638 squatters, their numbers are even higher. The country, in addition to taking measures to expel them. Finalizing and creating some on the finest ways to deal with the situation are systematic approaches and the same can never miss on anything.
The House Committee has a statement for long hold, privileged with records. The committee stated that no research has been conducted on the state ownership of wakf since 1957, and proper research will reveal the exact number of squatters. According to sources, the wakf committees in other states have established schools, hospitals, dormitories, etc. for the poor; in Assam, such properties are illegally occupied or abused.
